It should be born in mind that not everything that the Qur’an defines as Haraam is necessarily legally prohibited in the Shari’ah penal code. It seems to me that this is an important distinction to make.

So it is a valid question; is it legitimate to legally prohibit something that has no prescribed penalty in the Shari’ah, or is that overstepping?
