Imam Ash-Shafi’i’s statement that a Fiqh opinion cannot be imposed upon others is the sound position. You cannot impose upon me your opinion that a Fiqh opinion can be imposed upon me by the State. State backing does not elevate an opinion to the status of revealed Law; sorry.

It is a principle of Fiqh that you cannot impose a Fiqh opinion upon others and oblige them to follow; but ironically, the Fuqaha empower the State to impose Fiqh decisions…which is to say, in their opinion, their opinion can be imposed. What could go wrong?
