Regarding the selection of the ruler, as I queried earlier, if it is not to be according to the consent of the governed, if it is not to be determined through public elections, please inform me of the method?
In Egypt, for instance, do you adhere to strict tribal groupings which would enable the tribes’ mukhtars to form a selection committee? I doubt it. And even if that is the case, what is the guarantee that the mukhtars would not simply select a ruler who would serve their own personal benefit?
With regard to legislation, I do not see why proposed laws and regulations could not be submitted to a committee of fuqaha for review to determine their soundness in Shari’ah before the proposed legislation could be ratified
