The denunciation of utilizing democratic mechanisms in government because it means the implementation of “man-mde laws”, is frankly quite simplistic.
It is simplistic because, first of all, it ignores the standard practice of limiting the legislative powers of the government within the boundaries of a constitution. No laws can be passed which violate the state’s founding legal document. If that founding legal document stipulates, for instance, that the supreme law of the land is the Shari’ah, no administration will be able to impose laws that violate the Law of Allah and His Prophet.
But, it is also simplistic because it presupposes that any and all man-made laws are inherently un-Islamic, which is obviously false.
There is no government which does not necessarily enact man-made legislation. The Shari’ah does not inform you of where to lay a motorway, where to build a city, how to allocate the state budget, and so on. These are the types of issues that government is overwhelmingly busy with.
To say that it is kufr for the population to participate in the decision-making process over policies of the state that will impact their lives, is simply ludicrous. If it is not kufr for the ruler to make decisions, it is not kufr for the population to have an input in those decisions
