Any justice system is only ever going to be as good as the people implementing it. That is as true with the Shari’ah as it is with man made legislation. A good rule is not immune to manipulation or misuse. The law may be just, but the enforcers corrupt.
Rasulullah ï·º acknowledged the potential of legal manipulation when he said that some complainants may argue more eloquently and convincingly than others, even though the other party is in the right. There is no question about whether or not the Prophet was just, and no question that the Shari’ah is just; but that does not prevent abuse of the system.
It is naive to think “we just need to have the right rules in place, and everything will be better”…no…WE have to be better.
